Terms of Service
These Terms of Service ("Terms") govern your access to and use of the BODYSCULPT mobile application, website, and related services (collectively, the "Service") operated by Leo Ledden, trading as BODYSCULPT, United Kingdom ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 16 years old to use the Service. By using BODYSCULPT, you represent that you meet this requirement and have the legal capacity to enter into these Terms. Coaches are responsible for ensuring their clients meet applicable age and consent requirements in their jurisdiction.
2. Accounts and roles
You may register as a coach or a client. Coaches start with a 14-day free trial via our website checkout and receive an activation code by email. Clients join a coach's studio using an invite code provided by their coach. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
3. Coach subscriptions
Coach plans (Essentials, Growth, Ultimate) are billed monthly or yearly via Stripe according to the plan selected at checkout. Subscription fees, client limits, and included features are described on our website. After the free trial, you will be charged unless you cancel. Failure to pay may result in suspension of coach features.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Harass, abuse, or harm other users
- Upload content that is infringing, defamatory, obscene, or otherwise objectionable
- Attempt to gain unauthorized access to the Service, other accounts, or our systems
- Reverse engineer, scrape, or interfere with the normal operation of the Service
- Misrepresent your identity, qualifications, or professional credentials
We may suspend or terminate accounts that violate these Terms.
5. Health and fitness disclaimer
BODYSCULPT is a software platform for coaching and tracking fitness-related information. It does not provide medical advice, diagnosis, or treatment. Coaches and clients should consult qualified healthcare professionals before starting any exercise or nutrition program. You use the Service at your own risk.
6. Coach–client relationship
Coaches using BODYSCULPT are independent professionals or businesses. BODYSCULPT is not a party to agreements between coaches and clients and is not responsible for the quality, safety, or legality of coaching services provided through the platform. We do not take commission on payments coaches collect from clients.
7. Content and intellectual property
You retain ownership of content you submit to the Service. You grant us a limited license to host, store, display, and process that content solely to operate and improve the Service. The BODYSCULPT name, logo, software, and website content are our intellectual property and may not be copied or used without permission, except as allowed for coach branding features under eligible plans.
8. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
9. Third-party services
The Service may integrate with third-party devices, app stores, or services. Your use of those services is subject to their own terms and policies. We are not responsible for third-party services.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BODYSCULPT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR £100, WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify and hold harmless BODYSCULPT from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.
13. Termination
You may stop using the Service at any time and cancel your subscription in the Stripe billing portal. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive, including disclaimers, limitations of liability, and indemnification.
14. Changes to these Terms
We may modify these Terms from time to time. We will post updated Terms on this page and update the "Last updated" date. Material changes may be communicated via the app or email. Continued use after changes constitutes acceptance.
15. Governing law
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws in your country provide otherwise.
